What is standing in foreclosure law?

In foreclosure law, standing refers to a plaintiff's legal right to bring a foreclosure action. Before a lender or loan servicer can foreclose on a property in New Jersey, it must first prove to the court that it actually holds (or owns) both the promissory note and the mortgage securing the loan. The note is the borrower's written promise to repay; the mortgage is the lien on the property. Without possession of both documents, a plaintiff cannot demonstrate standing and has no valid claim to foreclose.

Standing matters because it prevents parties without a genuine financial interest in the loan from using the foreclosure process.
